Terms of Service for ZenPocket

1. Acceptance of Terms
By downloading, installing, or using the ZenPocket mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legal agreement between you and Colo, LLC (“we,” “us,” or “our”), a company based in Japan.
2. Description of Service
ZenPocket is a Zen Buddhism practice application that provides:
- FREE: A meditation timer (Zazen) with background music
- FREE: A library of 48 Buddhist texts and teachings
- FREE: Tools for tracking your meditation practice
- PREMIUM: AI-powered chat conversations with a Zen teacher
3. Subscription and Payment
3.1 Subscription Model
ZenPocket uses a freemium model:
- FREE FOREVER: Zazen timer, Readings library, and practice tracking
- PREMIUM ($4.99/month): AI-powered Chat with Zen teacher
No free trial is offered. Premium features require immediate payment upon subscription.
3.2 Pricing
- Monthly subscription for Chat access: $4.99 USD (or equivalent in your local currency)
- Prices may vary by region and are subject to change
- Subscription provides unlimited Chat access within daily rate limits
3.3 Payment Processing
- All payments are processed through Apple’s App Store
- By subscribing, you agree to Apple’s payment terms
- Subscriptions automatically renew unless cancelled
3.4 Cancellation and Refunds
- You may cancel your subscription at any time through your Apple ID settings
- Refunds are handled according to Apple’s refund policy
- No partial month refunds are provided
- Free features remain accessible after cancellation
4. User Conduct and Prohibited Uses
You agree NOT to:
- Use the App for any illegal purposes
- Attempt to reverse engineer, decompile, or hack the App
- Use the App to harass, abuse, or harm others
- Violate OpenAI’s usage policies in chat interactions
- Use the App for commercial purposes without permission
- Share subscription access with others
- Circumvent rate limiting or other technical restrictions
5. Intellectual Property
5.1 App Content
- The App’s design, features, and original content are owned by Colo, LLC
- Buddhist texts are in the public domain or licensed under Creative Commons
- All texts include proper attribution as required
5.2 User Content
- You retain ownership of your chat inputs
- We grant you a license to use AI-generated responses for personal use
- Chat conversations are subject to OpenAI’s terms of service
6. AI Chat Disclaimers
IMPORTANT: The AI Zen Teacher chat feature:
- Provides educational and contemplative content only
- Is NOT a substitute for professional medical, psychological, legal, or financial advice
- May produce inaccurate or inappropriate responses
- Should not be relied upon for critical decisions

7. Service Availability
- We strive to maintain service availability but do not guarantee uninterrupted access
- The App requires internet connectivity for chat features
- We reserve the right to modify or discontinue features with reasonable notice
- Scheduled maintenance may temporarily affect availability
8. Privacy and Data
Your use of the App is subject to our Privacy Policy. Key points:
- Chat data is stored locally on your device
- We do not store your conversations on our servers
- Device ID is used only for rate limiting

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided “AS IS” without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the subscription in the past 12 months
- We are not responsible for any harm arising from use or misuse of the App
10. Indemnification
You agree to indemnify and hold harmless Colo, LLC from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your use of the App
- Any content you submit through the App
11. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes through:
- In-app notifications
- Update to the “Last Updated” date
Continued use of the App after changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for:
- Violation of these Terms
- Abusive behavior
- Fraudulent payment
- Any other conduct we deem harmful to the service or other users
Upon termination, your subscription will be cancelled and local data may be deleted.
13. Governing Law and Disputes
13.1 Governing Law
These Terms are governed by the laws of Japan, without regard to conflict of law principles.
13.2 Jurisdiction
Any disputes shall be resolved in the Tokyo District Court, Japan.
13.3 International Users
If you access the App from outside Japan, you are responsible for compliance with local laws.
14. Miscellaneous
14.1 Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Colo, LLC.
14.2 Severability
If any provision of these Terms is found invalid, the remaining provisions shall continue in effect.
14.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver.
14.4 Assignment
You may not assign these Terms. We may assign our rights and obligations without restriction.
